Lusciano: rifiuti smaltiti illegalmente, 7 indagati

Si sono concluse le articolate e complesse indagini preliminari, coordinate dalla Procura della Repubblica, a carico di sette soggetti, ovvero tre imprenditori facenti parte della medesima società, Ditta individuale D.C.A., e un loro operaio, nonché tre affermati ingegneri, nelle rispettive vesti di pubblici ufficiali, quali direttori dei lavori e responsabile unico del procedimento, ritenuti responsabili, a vario titolo ed in concorso tra di loro, di condotte criminose che vanno dalla gestione illecita di rifiuti fino ad arrivare al falso ideologico in atto pubblico, alla frode in pubbliche forniture ed alla truffa, perpetrata anche nella forma aggravata.
L’attività, che si inserisce nell’ambito della problematica di emergenza ambientale della cosiddetta “Terra dei Fuochi”, trae spunto investigativo da un servizio di controllo del territorio svolto d’iniziativa dai Carabinieri Forestali del Nucleo Investigativo di Polizia Ambientale Agroalimentare e Forestale, NIPAAF, di Caserta, in sinergia con i Carabinieri della Stazione territoriale capoluogo. Nel corso di tale servizio venivano rinvenuti sulle colline casertane, nelle località denominate “Boschina”, “Sferracavallo” e “Cuna Vecchia”, notevoli abbandoni di rifiuti, anche pericolosi ed in alcuni punti combusti, provenienti da lavori di ristrutturazione edilizia, per un quantitativo complessivo di circa venti metri cubi.
Già in data 24 ottobre 2017, i militari provvedevano a sequestrare d’iniziativa le tre aree oggetto degli illegali sversamenti ed a notiziare i fatti rilevati all’AG sammaritana che, da tale momento, assumeva la direzione delle indagini.

In particolare, nelle tre aree poste in sequestro, venivano rinvenuti scarti edili, guaine bituminose, lastre di vetro camera di infissi in ferro od alluminio, materiale plastico vario, ossia tubature in pvc provenienti da sostituzione di impianti di gronda, fecali, vaschette di scarico per WC, canalette per impianti elettrici, filo elettrico, teli in plastica, sacchi in plastica con scritta grassello di calce, nonché un consistente numero di imballaggi contenenti residui di sostanze pericolose o contaminati da tali sostanze. Venivano anche rinvenute tracce di abbruciamento di materiale legnoso, quali porte e finestre, come si rilevava dai relitti di serrature in ferro presenti sul posto.
In considerazione della tipologia dei rifiuti ritrovati, si intuiva che gli stessi fossero certamente riconducibili a lavori di tipo edile presumibilmente provenienti da una pubblica struttura in considerazione delle dimensioni delle vetrate rinvenute, tipiche di edifici pubblici.
Tra i rifiuti smaltiti illegalmente veniva reperita, altresì, documentazione cartacea dalla quale emergevano elementi tali da far presupporre che gli stessi provenissero da lavori eseguiti presso un Istituto Scolastico di Lusciano.
Le successive indagini consentivano di verificare che detti rifiuti provenivano effettivamente dai lavori di adeguamento strutturale di un plesso scolastico comprensivo, scuola dell’infanzia e scuola primaria, del luscianese e che, su istigazione del rappresentante legale della ditta esecutrice dei lavori, i rifiuti erano stati smaltiti illegalmente da un proprio operaio, tale C.F., sulle colline casertane, ove, tra l’altro, quest’ultimo risiede, avvalendosi di un automezzo dell’impresa.
